The Studio

The Studio is operated by Embrace Fitness (’the Company’) whose principal objective is to provide health and leisure programmes for Members and their Guests. The Company has appointed a Management team (’the Management’) who are responsible for the operation of the Studio in accordance with these Membership Rules as amended from time to time.

Membership

a) Membership is subject to the Membership Rules as are from time to time in force and which may be amended by the Management at any time.

b) The Management reserves the right to reject an application for Membership to the Studio for any reason whatsoever.

c) Membership is personal to the Member and is non-assignable, nontransferable and non-refundable. The Company may assign the benefit of these agreements to any person, firm or company at any time without notice to the Members.

d) Upon acceptance, the Member shall be entitled to all the rights and privileges exercisable for which his/her application has been accepted.

e) Membership Fees

  i. You agree to pay the fees as stated on the front of this contract. If you are under 18, Embrace Fitness requires a parent or guardian to provide consent. Embrace Fitness immediately earns the administration and pre-paid class fees when you buy your membership. These fees and any prepaid fees are not refundable or surrendered for cash value.

  ii. Purchase of Pre-Paid Classes

    You can purchase multiple Pre-Paid classes. Unconsumed Pre-paid classes cannot be surrendered for any cash value.

  iii. Redemption of Pre-Paid Classes.

    The prepaid classes purchased will be stored in your Embrace Fitness online database. To redeem your prepaid classes, you will have to login to your Embrace Fitness online database or present your user name over the counter or via phone and register for the session of your choice. At the point of redemption, you may choose with pricing option to deduct the class from.

  iv. Expiry of Pre Paid classes

    All purchases pre-paid classes will have a fixed stipulated expiry period starting from the date of the first visit used in the package. The expiry will not be further extended even after purchase of new packages. Expired sessions will not be reinstated.

  v. Extension of Expiry of Pre Paid Classes

    You can purchase a 1-week extension of the expiry date only over the counter or over the phone. Charges for the extension of the expiry date is non-refundable.

f) Memberships are available to individuals who have attained a minimum age of 6 years.

Limitation of Liability

In consideration for the Management accepting his/her application for Membership of the Studio, and for he/she becoming and remaining Member of the Studio, the Member agrees that:

a) Neither Embrace Fitness Studios, its associated companies, employees or agents shall be responsible for any claims, demands, injuries, damages, or actions for negligence arising on account of death or due to injury, loss, damage or theft to a member’s person or property arising out of, or in connection with the use by a Member of any of the services, facilities or premises of Embrace Fitness Studio.

b) The Member hereby holds Embrace Fitness, Embrace Fitness Studios, its associated companies, employees and agents harmless from all claims which may be brought against them by or on a Member’s behalf for any such injuries or claims afore said.

Physical Condition of Member

a) The Member warrants and represents that he/she is in good physical condition and that he/she knows of no medical or other reason why he or she is not capable of engaging in active or passive exercise and that such exercise would not be detrimental to his/her health, safety, comfort or physical condition.

b) The Member shall not use any Studio facilities whilst suffering from any infections or contagious illness, disease or other ailment such as open cuts, abrasions, open sores or minor infection, where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of the other Members and Participants.

Expulsion of Members

a) The Management may terminate the Membership of any Member:

  i. Without notice and with immediate effect if the Member’s conduct, whether or not such conduct is the subject of complaint by another Member or Members, is such that in the reasonable opinion of the Management, it may be injurious to the character or interests of the Studio.

  ii. Without notice and with immediate effect if the Member shall have committed any breach of these Terms and Conditions or of the Rules and Regulations of the Studio as are from time to time in force.

  iii. Upon notice in writing, if the Company is of the opinion that the Member is not a suitable individual for continued Membership of the Studio. All decisions of the Management under this clause are final and binding.

b) A Member whose Membership is terminated by the Management shall forfeit all the privileges of Membership with immediate effect without claim for any refund of his/her Admin Fee or Pre-Paid Session fees. On termination of his/her membership, the Member shall return forthwith his/her Membership Card and/or any other evidence or property of Membership provided to that Member by the Studio and shall settle any outstanding debts.

Studio

a) All Members are encouraged to undertake a Fitness Evaluation conducted by their own medical professional before starting any exercise programme.

b) Dress code: all members and guests are required to wear proper gym attire when exercising. A top is required that covers the chest area, no torn clothing items are permitted. Closed toe, non-marking, rubber soled shoes are required at all times in the Studio unless otherwise instructed by the qualified instructors. Members should be considerate of other members and wipe down equipment with hand towels and not dominate specific equipment when the studio is full.

c) Instructors are authorized to stop anyone from exercising if he/she is judged unsafe. Users must abide by the instructions of the fitness instructor.

d) The company reserves the rights to cancel, change the class type or instructor without prior notice.

Class Bookings

a) Members can make their class booking via phone, in person at the registration counter, or via the Online Booking System.

b) Members cannot make overlapping class bookings.

c) Class cancellation done at least 24 hours before class commences will not be penalised. Members can make their cancellations via phone call or at the registration counter.

d) For classes booked using a pre-paid package, class cancellations done within 24 hours before class commences will be considered as a consumed session and the session will be deducted from the pre-paid class package.

e) For classes booked using a unlimited monthly membership, class cancellations done within 24 hours before class commences will be considered as being absent from class.

f) Online Class Bookings and Cancellations will be closed 24 hours before the class commencement date.

g) Class booking (subjected to availability of vacancies) and cancellations will still be available via phone call or registration counter.

h) Vacancy available for online waiting list is on a first-come-first-serve basis.

i) When a vacancy is available, an email will be sent to the next member on the online waiting list for that particular class. The member who is offered can choose to accept and acknowledges the email or decline, of which the slot will then be offered to the next person on the waiting list.

j) Email will be sent to inform members only if they have been offered a class vacancy.

k) Online waiting list will expire 2 hours before class commences. After which members may want to join the Walk-in Queue at the reception.

l) Members are expected to mark their attendance at the respective club at least 5 minutes before the class commences. Attendance marking starts 30 mins before the class commences.

m) If the member is not present at the respective club by 5 mins before class commencement, the reserved slot will be released to another member who is queuing at the reception and the member will be treated as absent from the class booked.

n) Members will not be allowed to a class without marking attendance.

o) Attendance cannot be marked if a class has already commenced.

p) For classes booked using unlimited monthly membership, Members will be liable for a penalty fine of $30 if they are absent from 3 of the classes they have booked and will not be able to attend a class until they have paid the penalty fine.

Others

a) Members and their guests are not permitted to bring their own food and/or drinks into the Studio.

b) Lost property will be held for a period of 3 months after which the management reserves the right to dispose of the items in any way it sees fit. No claims shall be entertained after this period.

c) The Management reserves the right to use any individual or group photographs of Members and/or Guests for press or promotional purposes.

d) The Management may from time to time wish to show potential Members or others around the Studio and allow them to use the Studio facilities on a trial basis and reserves the right to do so.

e) The Studio’s schedule are indicated at the Embrace Fitness Website. The Management reserves the right to adjust the hours for the purpose of cleaning, decorating, repairs or for special private functions and holidays. The Management shall endeavour to give reasonable notice of any lengthening or shortening of such hours.

f) Smoking is not permitted in any part of the Studio.

g) Members may not use the facilities of the Studio while under the influence of alcohol, steroids, narcotics or other mood altering substances.

h) The failure of the Management or the Company to enforce any of their respective rights at any time for any period shall not be construed as a waiver of such rights.

i) The Management may at its sole discretion amend, vary, delete or add to these Membership Rules with immediate effect. Members will be advised of any changes by notification via the members emailing list.

j) No photography / video taking is permitted within the Studio premises unless authorized by the management of Embrace Fitness.

k) These Membership Rules shall be governed and constructed in accordance with the laws of Singapore and subjected to the jurisdiction of Singapore.
